New Vision: Security Operations Center and CIU...

Flashback over 8 years ago when there was a convergence of thinking about the topic of a "Defensible Standard of Care" going on in the industry.

The key Operational Risk Management news from the 2011 RSA Conference was coming in, yet there were inside sources who still needed to be interviewed. What did they think was the most brilliant presentation or idea(s) presented?

This particular release caught some eyes as it addressed much of the thinking on the latest evolution of the Security Operations Center (SOC).  How much of this is still relevant today:

New Vision for Security Operations: Six Core Elements
The vision includes six core elements and prescriptive guidance for how to incorporate these elements into existing security operations. These elements include:
  • Risk planning: The new SOC will take a more information-centric approach to security risk planning and invest in understanding which organizational assets are highly valuable and essential to protect. With priorities based on GRC policies, security teams need to conduct risk assessments that focus on the “crown jewels” of the enterprise.
  • Attack modeling: Understanding attack modeling in a complex environment requires determining which systems, people and processes have access to valuable information. Once the threat surface is modeled, organizations can then determine potential attack vectors and examine defense steps to isolate compromised access points efficiently and quickly. RSA® Laboratories has developed theoretical models based on known APT techniques and employed game theory principles to identify the most efficient means of severing an attack path and optimize defense costs.
  • Virtualized environments: Virtualization will be a core capability of tomorrow's SOC – delivering a range of security benefits. For example, organizations can "sandbox" e-mail, attachments and URLs suspected of harboring malware. Anything suspicious can be launched in an isolated hypervisor and the virtual machine can be cut off from the rest of the system.
  • Self- learning, predictive analysis: To remain relevant in tomorrow's IT environment, a SOC will need to truly integrate compliance monitoring and risk management. The system should continually monitor the environment to identify typical states which can then be applied to identify problematic patterns early. Statistic-based predictive modeling will be able to help correlate various alerts. Developing such a system will require real-time behavior analysis innovations, although some of these elements are available today.
  • Automated, risk-based decision systems: A key differentiator of a more intelligent SOC will be its ability to assess risks instantly and vary responses accordingly. Similar to risk-based authentication, the SOC will employ predictive analytics to find high-risk events and then automatically initiate remediation activities. The prospect of dynamic typography is one of the most exciting areas of this type of systems automation for the cloud. To implement an APT, an attacker must understand network mapping and be able to model it. In response to this, organizations can remap their entire network infrastructure to disrupt an attacker’s reconnaissance efforts. This is akin to physically rearranging a city at frequent intervals – and the entire process can be automated so that links between systems stay intact and dependencies are handled without human intervention.
  • Continual improvement through forensic analyses and community learning: Although forensic analysis can be resource-intensive, it is an imperative element of a SOC and key to mitigating the impact of subsequent attacks. Virtualized environments can provide snapshots of the IT environment at the time of the security event providing useful information if detection of the attack was delayed. Having a way to share information about attack patterns will be the future of the SOC. This concept should be embraced in order to exchange threat information within respective industries and better predict the path of the APT and thereby determine countermeasures.
The evolution of the SOC in your enterprise may start in some unconventional places. Who is it in your organization that is responsible for the loss of corporate assets?

Who in your company is the one who determines what items are counted as losses to the bottom line?

Who does the enterprise look to when the crisis hits and people are looking for answers in minutes, not hours, or days?

Who picks up the phone to answer the call from the local FBI Field Office?

These may not be the people you think of in the CIO's office or IT department. These people however need to be part of the combined Security Operations Center solution in the company.

The Advanced Persistent Threat (APT) now requires the intersection of prudent strategy from the business leadership, the accounting or finance leadership and the risk management leadership.

If the CIO is looked upon as the key executive running a "Utility" inside the enterprise, think again.

Beyond the utilization of threat assessment or management teams, enterprises are going to the next level in creating a "Corporate Intelligence Unit" (CIU). The CIU is providing the "Strategic Insight" framework and assisting the organization in "Achieving a Defensible Standard of Care."

The framework elements that encompass policy, legal, privacy, governance, litigation, security, incidents and safety surround the CIU. It includes with effective processes and procedures that provides a push / pull of information flow. Application of the correct tools, software systems and controls adds to the overall milestone of what many corporate risk managers already understand.

The best way in most cases to defend against an insider attack and prevent an insider incident is to continuously help identify the source of the incident, the person(s) responsible and to correlate information on other peers that may have been impacted by the same incident or modus operandi of the subject. "Connecting The Dots" with others in the same company or with industry sector partners, increases the overall resilience factor and hardens the vulnerabilities that are all too often being exploited for months if not years.

In retrospect, you can be more effective investigating and collecting evidence in your company to gain a "DecisionAdvantage". To pursue civil or criminal recovery of losses from these insider incidents, you may not go to law enforcement, but it's likely they will come to you once they get a whistle blower report, catch the attacker and/or they have the evidence that you were a victim.
How your organization pulls together the right people to staff and operate your "CIU" is going to depend on your culture, funding and current state of the threat.
BALTIMORE -
It has been a month since the City of Baltimore's networks were brought to a standstill by ransomware. On Tuesday, Mayor Bernard "Jack" Young and his cabinet briefed press on the status of the cleanup, which the city's director of finance has estimated will cost Baltimore $10 million—not including $8 million lost because of deferred or lost revenue while the city was unable to process payments. The recovery remains in its early stages, with less than a third of city employees issued new log-in credentials thus far and many city business functions restricted to paper-based workarounds.
Here is another thought. A thorough review of the current funding, staffing and strategy of a SOC or CIU in the enterprise, may even become a priority at the next "Board of Directors" meeting.

Preemption: An Operational Risk Perspective...

Preemption - A Knife That Cuts Both Ways by Alan M. Dershowitz should be considered for the professional Operational Risk Managers reference library:

Decisions to act preemptively generally require a complex and dynamic assessment of multiple factors. These factors include at least the following:
  1. The nature of the harm feared.
  2. The likelihood that the harm will occur in the absence of preemption.
  3. The source of the harm--deliberate conduct or natural occurrence?
  4. The possibility that the contemplated preemption will fail.
  5. The costs of a successful preemption.
  6. The cost of a failed preemption.
  7. The nature and quality of the information on which these decisions are based.
  8. The ratio of successful preemptions to unsuccessful ones.
  9. The legality, morality, and potential political consequences of the preemptive steps.
  10. The incentivizing of others to act preemptively.
  11. The revocability or irrevocability of the harms caused by the feared event.
  12. The revocability or irrevocability of the harms caused by contemplated preemption.
  13. Many other factors, including the inevitability of unanticipated outcomes (the law of unintended consequences).
Regardless of the agreement or bias of the reader, this book makes you think upside down and sideways about decisions you have made, and will make.

While Mr. Dershowitz takes time to make his own opinions known, his mastery of building the foundation for transformation is unequaled on such a topic; controlling dangerous and destructive human behavior and how to confront terrorism, crime and warfare.

During the course of a single day in the life of the Operational Risk Manager there are dozens if not hundreds of preemptive or preventive decisions to be made.

Private Sector vs. Public Sector is not so much the issue here. Whether you are the Chief Operational Risk Officer at a major banking institution or the Commander in the local Emergency Operations Center, you both have the same dilemma.

A decision must be made quickly and you must be able to live with the implications of either decision.

InTP: Insider Threat Via Critical Infrastructure...

The private sector organizations of the United States are vital to the protection and security of the Homeland.  The private sector owns a majority of our assets and Critical Infrastructure Protection (CIP) remains a priority as a result of the latest asymmetric threats.  Securing Critical Infrastructure sectors includes:
  • Chemical:
  • Commercial Facilities:
  • Communications:
  • Critical Manufacturing:
  • Dams:
  • Defense Industrial Base:
  • Emergency Services:
  • Energy:
  • Financial Services:
  • Food and Agriculture:
  • Government Facilities:
  • Healthcare and Public Health:
  • Information Technology:
  • Nuclear Reactors, Materials, and Waste:
  • Transportation Systems:
  • Water and Wastewater Systems:
The National Strategy to Secure Cyberspace, emphasizes the importance of public/private partnerships in securing these critical infrastructures and improving national cyber security.
Similarly, one focus of the Department of Homeland Security is enhancing protection for critical infrastructure and networks by promoting working relationships between the government and private industry.

The federal government has acknowledged that these relations are vital because most of America’s critical infrastructure is privately held.  Further, the networks of our global super-infrastructure are tightly “coupled”—so tightly interconnected, that is, that any change in one has a nearly instantaneous effect on the others.

Attacking one network is like knocking over the first domino in a series: it leads to cascades of failure through a variety of connected networks, faster than most human managers can respond.

We realize that there are many facets of CIP, yet where should we be allocating resources?  The vigilance within our organizations has not changed and is based upon previous studies done by CERT and the US Secret Service:
"A system administrator, angered by his diminished role in a thriving defense manufacturing firm whose computer network he alone had developed and managed, centralized the software that supported the company’s manufacturing processes on a single server, and then intimidated a coworker into giving him the only backup for that software. Following the system administrator’s termination for inappropriate and abusive treatment of his coworkers, a logic bomb previously planted by the insider detonated, deleting the only remaining copy of the critical software from the company’s server. The company estimated the cost of damage in excess of $10 million, which led to the layoff of some 80 employees." Insider Characteristics

The majority of the insiders were former employees.

• At the time of the incident, 59% of the insiders were former employees or contractors of the affected organizations and 41% were current employees or contractors.

• The former employees or contractors left their positions for a variety of reasons. These included the insiders being fired (48%), resigning (38%), and being laid off (7%).

Most insiders were either previously or currently employed full-time in a technical position within the organization.

• Most of the insiders (77%) were full-time employees of the affected organizations, either before or during the incidents. Eight percent of the insiders worked part-time, and an additional 8% had been hired as contractors or consultants. Two (4%) of the insiders worked as temporary employees, and one (2%) was hired as a subcontractor.

• Eighty-six percent of the insiders were employed in technical positions, which included system administrators (38%), programmers (21%), engineers (14%), and IT specialists (14%). Of the insiders not holding technical positions, 10% were employed in a professional position, which included, among others, insiders employed as editors, managers, and auditors. An additional two insiders (4%) worked in service positions, both of whom worked as customer service representatives.


Making sure that you have a robust workplace awareness program is yet one key component in addressing the "Insider Threat" and our resilience.

More importantly, the timing may have been the perfect launch point for other malfeasance from non-state actors who lie in their "Lone Wolf" mode, waiting to strike.

And while the scenario could be well contained, the timing could create opportunities for the "Black Swan" outlier inside your enterprise.

It's never to early to plan for the unimaginable, all happening in the same geography and the same time frame.  Revisit your "Insider Threat Program" (InTP) and Critical Infrastructure Resilience today...

Unthinkable: Adapting in New World Disorder...

Will 2018 bring more data breaches, lost laptops and insider threats than 2017?  This is why CSO's, CPO's and corporate General Counsels have their teams working overtime.

When the enemy is increasing their attacks, utilizing new strategies and leveraging the existing base of compromised organizational intellectual and data assets, the future horizon becomes ever more clear. 

The statistics don't lie.  1579 documented Data Breaches occurred in 2017. Up 44.7% according to reports by the Identity Theft Resource Center (ITRC) compared to the previous year.  It is the new normal.

The Insider Threat Program (InTP) however, remains a key focus for Operational Risk Management (ORM) professionals because human behaviors are exaggerated during periods of stress, fear and uncertainty. This means that people who may have never considered doing something to jeopardize their reputations, may now be up against a wall.

When there is no obvious exit and no way out, people will do extraordinary things to get ahead, beat the odds and hedge their own risk portfolio of life.

In Joshua Cooper Ramo's book "The Age of the Unthinkable", "Why the New World Disorder Constantly Surprises Us and What We Can Do About It" the author discusses the concept of Deep Security. His analogy of how to think about "Deep Security" is the biological immune system:
"A reactive instinct for identifying dangers, adapting to deal with them, and then moving to control and contain the risk they present."
The key word in Ramo's writing is "Adapt".  Being Adaptive.  However, prior to this there are two other very vital words that we feel are even more imperative. Instinct. Identifying. In other words, Proactive Intuition.

Ask any savvy investigator on how she solved the case and you may hear just that, "I had a hunch."

Talk with a Chief Privacy Officer in any Global 500 company.  You might get them to admit they have a sense that their organization will be the target of an "Insider data breach" incident in the coming year or two.

Do you remember signing off on reading and your acceptance of the employee handbook?  When did your organization last make changes to the Corporate Employee policies?  We would start with the updates to the following sections:

  • SOCIAL MEDIA POLICY
  • REMOTE ACCESS POLICY
  • E-MAIL, VOICE MAIL AND COMPUTER NETWORK SYSTEM PRIVACY

  • SYSTEMS USE RESTRICTED TO COMPANY BUSINESS
  • FORBIDDEN CONTENT
  • PASSWORD SECURITY AND INTEGRITY
  • INTERNET ACCEPTABLE USE POLICY
  • POLICY ON USE OF SOFTWARE
  • COMPANY PROPERTY
  • PROTECTION OF TRADE SECRETS/NON-DISCLOSURE OF COMPANY INFORMATION 
Due to the increasing complexity of IT systems, cloud computing, data networks and the hundreds or thousands of laptops and mobile devices circling the globe with company executives and employees is enough to predict that a major breach will occur.

Being adaptive and having proactive intuition in the modern enterprise does not come natural. You have to work at it and it requires a substantial investment in time and resources to make it work effectively.  Proactive Intuition.

Once you realize that all of the controls, technology and physical security are not going to keep you out of harms way, you are well on your way to reaching the clairvoyance of "The Age of the Unthinkable."

Critical Infrastructure: "Known Vulnerabilities" in Your Enterprise...

What are the known vulnerabilities in your enterprise architecture?  We will come back to this question.

Asymmetric Warfare across the globe spans a digital Internetwork that has it's roots fostered in openness and with little regulation.  We are in many instances within real possibilities of significant digital systems failures.  Here is a just small window into that battlefield.

Operational Risk Management (ORM), is a mature discipline that you and your organization shall embrace, study, expand and continuously support.  One facet of Operational Risk, the Information Technology (IT) systems in your enterprise, is not part of an evolution any longer.  It has become a pervasive and mobile social revolution, that is now accelerating beyond your comprehension.

Let's put it another way.  Known but unmitigated vulnerabilities, will likely be the origin of your demise, failure, damage, ruin and loss of precious assets.  Why do you let it continue?

You and your organization are on the edge, operating each day with peoples lives, reputations and Personal Identifiable Information (PII) at stake and even the livelihood of the enterprise itself.

Whether that is your family, business, state or even your country, you can do something more to address your known vulnerabilities.  Do you know who, what and where they are in your enterprise?

When you hear the name "Equifax" today, what do you think?  Data security breach, correct?  What about these organizations:

These are all well known companies, who have reported data security breaches by law, to the State of California, over the past 6 months.  There are dozens more of other organizations who are not large, well known brand names such as these.  Some are as a result of the Equifax breach and organizations who were using Equifax product solutions internally.  Now multiply this by 50 states.

So what?

Our Critical Infrastructure(s) in the United States are something we just take for granted.  Bank ATM's on every corner, bridges across bays and rivers, trains and planes departing from even small cities, trauma hospitals, massive hotels and supermarkets, fiber communications and LTE wireless network connectivity almost everywhere.

Let's come back to where we started.  What are the "Known Vulnerabilities" in your enterprise architecture?  Why are you so certain, that your adversaries are not currently inside your network?

The resilience modernization of your particular enterprise, is going to be expensive.  Mostly, because it has been patched and poorly integrated for a decade or more.  In some cases, simply because your adversaries and competition are more stealthy than you are.  Faster than you are.  Smarter than you are.  Laying in wait.

So what are you going to do about it?  In your home, business, city, state, or country and beyond?

You are going to find, repair and replace your known vulnerabilities.  Then repeat.  When you think you are finished, you can begin the next project, on your UNKNOWN vulnerabilities.

Proactive Defense: ICT Supercomputers in the Fifth Domain...

The days are numbered for the major and large scale ICT (Information, Communications & Technology) incidents.  Corporations and global 500 organizations are scaling up for the long game, in a new era of Operational Risk Management (ORM).  We are rapidly moving from Fear, Uncertainty and Doubt, to "Proactive Defense."

No longer, is the topic of digital strategy being pushed down on the list of priorities by the Board of Directors; it is now at the top.  E-commerce and digital branding are an integrated dialogue along with EBITA in the corporate board room.  The "Trust Decisions" being made each minute of each hour by the enterprise, are now being calculated by machines, sophisticated algorithms and data analytics.
In an increasingly virtual world, it’s easy to lose sight of the fact that human networks, relationships and trust are more important than ever. Those bonds can be sparked in face-to-face discussions. Meanwhile, we can’t allow ourselves to be passive when our opponents are actively engaged and financially motivated. Since we have such a determined foe, we need to challenge each other on the stage. We need to change from thinking defensively to proactively on ICT.--William H. Japan and other nations are racing each other to create the worlds fastest-known supercomputer.  Why?

The deep learning and artificial-intelligence (AI) trend tells us that soon more corporations will be leveraging these government-owned assets for assistance.  Whether it is for medical diagnostics, cyberspace threat intelligence or improving the speed of other humanitarian focused equations, Japan is also joining the supercomputer race for the fastest computer on earth:

"In a move that is expected to vault Japan to the top of the supercomputing heap, its engineers will be tasked with building a machine that can make 130 quadrillion calculations per second - or 130 petaflops in scientific parlance - as early as next year, sources involved in the project told Reuters.

At that speed, Japan's computer would be ahead of China's Sunway Taihulight that is capable of 93 petaflops".


Why is the global race for supercomputer superiority a nation-state issue?  What is the reason for diverting national funds to this project, over others of key importance to the welfare of the majority of the population?  Operational Risk Management of the nation itself.

The "Fifth Domain" after Air, Land, Sea and Space is that infrastructure comprised of our planetary ICT landscape.  Digital infrastructures are now so integrated that cyberspace incidents such as war in Estonia, Stuxnet in Iran, Sony Pictures in the U.S. and the more pervasive "Ransomware" worldwide, are just the initial indicators of what still lies ahead of us.

We must now turn our attention to the positive innovation and continuous "Proactive Defense" of our critical infrastructure.  Nation states such as Japan and others, who are the key gateways for undersea cables, truly understand the vital nature of their ICT assets.

A nation states "Cyberspace Strategy" has now evolved beyond the current state, to the "Fifth Domain".  Global 500 companies are fighting DDoS botnets on a daily basis trying to keep e-commerce running.  This largely invisible war, will continue to evolve as new technologies and supercomputers become the new normal.

"On Tuesday, the chancellor, Philip Hammond, announced that the government was “investing” £1.9bn in boosting the nation’s cybersecurity. “If we want Britain to be the best place in the world to be a tech business,” he said, “then it is also crucial that Britain is a safe place to do digital business… Just as technology presents huge opportunities for our economy – so to it poses a risk. Trust in the internet and the infrastructure on which it relies is fundamental to our economic future. Because without that trust, faith in the whole digital edifice will fall away.”

Intuition: Security in a World Without Borders...

On a crisp Fall morning, one week after the U.S. National Election we were lining up outside the Harry S. Truman Building outside the United States Department of State.  The Bureau of Diplomatic Security - Overseas Security Advisory Council was hosting it's 31st Annual Briefing.

This years briefing was focused on "Security in a World Without Borders" and as we passed through our ID check and screening, the anticipation was high.  It's private sector constituents from the Fortune Global 500 to the small U.S.-based professional services firm had one key similarity.

Leaders in attendance recognize that their business is integrated forever with a exponentially expanding system of interconnected machines.  CxO's across the globe are competing for business in the era of "The Fourth Industrial Revolution" where the vulnerabilities extend beyond the Critical Assets of the enterprise.

This years keynote address was by Richard Davis, CEO of U.S. Bancorp.  His talk was heartfelt by many as he recounted his rise from the days at the branch level securing the vault.  Now he emphasized most of his effort was focused on Operational Risk Management (ORM).  Data, Identities and Distributed Denial of Service (DDoS) were on his mind everyday now.

Beyond the threats of a Post-ISIL Levant and operating in a world of Transnational Organized Crime, the room was almost full on Day 2 for this 10:45AM panel discussion:  "Developing an Insider Threat Program" and was moderated by Elena Kim-Mitchell, ODNI.

The OSAC participants on the panel were:
  • Roccie S., Capital One | Financial
  • Stanley B., Rolls-Royce North America | Defense Industrial Base
  • Joseph L., Southern Company | Energy
Each of these experts described the high-level architecture of their respective organizations design and approach to an "Insider Threat Program" (InTP) and they had consensus on one key element.

The "Human Factor".  The point that they all wanted to insure the audience understood clearly, is that all of the analytics software, data loss prevention (DLP) tools and sophisticated technology was not going to stop a determined and motivated adversary.

So what?

Your intuitive abilities as a human shall not be ignored or discounted.  How many times have you said to yourself, "I knew something wasn't right with that person".  In fact, many times we are alerted to the anomalous behavior of a co-worker because we have the human-factors of intuition that is working 24x7 in our brains.

Gavin de Becker has said it best in his book "The Gift of Fear," yet we must not forget that behavior is something that can be applied to everyone:
  • We seek connection with others.
  • We are saddened by loss and try to avoid it.
  • We dislike rejection.
  • We like recognition and attention.
  • We will do more to avoid pain then we will do to seek pleasure.
  • We dislike ridicule and embarrassment.
  • We care what others think of us.
  • We seek a degree of control over our lives.
As our software systems learn and we begin to rely more often on the algorithms to recognize, translate and predict, we must not lose sight of our human intuition.  Do you have it?  Yes.  Are you using it more often and more effectively?  We hope you will be.

How often have we all said, the signs were there.  How many times are the clear and present indicators in the workplace being ignored?  A organizations "Duty of Care" is continuously at stake.  Human Factors alone, just as software systems alerts alone will continuously expose the enterprise to significant loss events.  Here is just one example from the Washington Post:

The Pentagon’s Defense Security Service announced this year that contractors will be required to implement programs that are designed “to detect, deter and mitigate insider threats.” Contractors will be required to designate a senior insider threat official to oversee the program and provide training on how best to implement it.

While many details of the Martin case are not yet known, it is clear that it is not good for Booz Allen to have a second employee charged with stealing secrets from one of its most important customers, officials said.

POTUS 45: The Future of Information Warfare...

The spectrum of asymmetric warfare being waged across the globe has been accelerating for over a decade.  The physical realm, has now migrated to an environment of "zeros and ones" traveling at the speed of light.  Operational Risk Management (ORM) remains a significant factor for Senior Leadership in government and the private sector.

Information collection, deception, attribution and mutual response is consuming our airwaves and IP addresses, like a digital Tsunami.  Wikileaks vs. Edward Snowden, is a battle for digital privacy branding and a communications platform for the evidence of the truth.

The average world citizen is now reading content and consuming video by the petabyte, to satisfy their particular knowledge appetite.  The personal or nation state requirements of the continuous search for the truth, or perseverating on a single target to achieve a mission, is now the state of play.

As the United States pursues the election of its 45th President, the digital trust of our electoral systems and historical decision process are currently at stake.  Data provenance is at the center of legal and national security policy discussions.  "Trust Decisions" are ever more in our minds and simultaneously at the center of our democratic way of life.
Gawker publishing opposition research.  APT29 malware?  Guccifer2 account by a lone individual? Any similar attributes between the U.S. DNC malware servers and the German Bundestag malware servers?
The speed and sophistication of nation state plots or non-state actors, will continue to feed the novels for people such as John le Carre and yet to be written movie screenplays.  Yet what is now over the horizon for humanity and our future, lies in the innovation and current capability of Artificial Intelligence (AI):
Rob McHenry: Public-funded research has always pushed the state-of-the-art in advanced autonomy, which then drives commercial AI. I think many people would be surprised by the advanced capabilities that autonomous systems for defense are already demonstrating – capabilities that many might guess wouldn’t be achievable for many years.

For example, DARPA and the Navy are testing at sea today an autonomous ship that is designed to go “toe-to-toe” against a human adversary in the wild during complex unconstrained military operations. The ACTUV (Anti-submarine warfare Continuous Trail Unmanned Vessel) program has delivered an unmanned ship that can not only comply with the complex Rules of the Road in the open ocean, but simultaneously track and harass a manned submarine, keeping a step ahead of a highly trained human submarine captain. This is an example of AI that can understand humans, in both competitive and supportive roles.
As the U.S. Navy and others pursue the asymmetric battlefield across the oceans, we can only hope the human factor remains the man-in-the-middle.  Artificial Intelligence may very well be good at searching, collecting and manipulating data, yet it is still the human behind the intent.

In essence, humans remain the architects of the design, coding and the implementation of the programs, weapons and capabilities.  Where is the trail of evidence leading and where is the response?

Achieving digital trust and the future integrity of our global "TrustDecisions" will remain a tremendous challenge for our governments and the private sectors,  that establish our critical infrastructure.

Utility of Attack: Target Selection and Execution...

The threat spectrum for Operational Risk Management (ORM) professionals is wide and they are constantly evaluating opportunities to learn.  Recent data breaches, terrorist attacks and the strategies utilized by adversaries online and on the ground, has surfaced another key lesson learned:
u·til·i·ty n. (pl. -ties) 1 the state of being useful, profitable, or beneficial (in game theory or economics) a measure of that which is sought to be maximized in any situation involving a choice.  The New Oxford American Dictionary
Here are two data breach examples:
  1. On May 30, 2016, Omni Hotels discovered they were the victim of malware attacks on their network affecting specific point of sale systems on-site at some Omni properties. The malware was designed to collect certain payment card information, including cardholder name, credit/debit card number, security code and expiration date. They have no indication that reservation or Select Guest membership systems were affected.  50,000 records are impacted.
     
  2. Prior to May 2016, identity thieves stole tax and salary data from big-three credit bureau Equifax Inc., according to a letter that grocery giant Kroger sent to all current and some former employees. The nation’s largest grocery chain by revenue appears to be one of several Equifax customers that were similarly victimized this year. Atlanta-based Equifax’s W-2 Express site makes electronic W-2 forms accessible for download for many companies, including Kroger — which employs more than 431,000 people.  According to a letter Kroger sent to employees dated May 5 2016, thieves were able to access W-2 data merely by entering at Equifax’s portal the employee’s default PIN code, which was nothing more than the last four digits of the employee’s Social Security number and their four-digit birth year.
Here are two terrorist attack examples:

In two major domestic terrorism events in the United States this past year, "Utility" was a major factor and should not be discounted, in analyzing motivations and "modus operandi" of homegrown violent extremists.  In San Bernardino, CA the adversaries were planning a major attack and had already stockpiled explosives and ammunition.  In Dallas (Mesquite), TX the adversary was planning a major attack and had already stockpiled a cache of explosives as well.

In both of these cases, the adversaries had accumulated and trained to use explosives in an attack.  Then they came upon a choice.  A utility.
  1. In San Bernardino, an incident with government co-workers motivated the employee attacker to deviate from the intended plans and to capitalize on the "Utility" of a workplace holiday gathering at the county facilities.
  2. In Dallas, a peaceful protest march that would attract a significant government presence of police officers, motivated the attacker to deviate from future plans and to capitalize on the "Utility" of a public gathering.
Dr. Erroll Southers is correct:
While the impetus for attack is rooted in beliefs, a terrorist’s selection of how and where to attack is based on a consideration of utility. This is the estimate of an attack’s consequences with respect to the intended target’s value as a domestic or international interest and the political impact the attack will have on the intended audience. Utility is a primary consideration for extremists during preparation for an attack, weighing desired results against the investment in activities to plan, rehearse and execute an operation. Always mindful of the aftermath, utility weighs heavily in the decision-making process of target selection, possible attack paths, methodologies and execution.  Southers, Erroll (2014-09-25). Homegrown Violent Extremism (pp. 9-10).
In both cases, the adversaries accelerated their plans.  They abandoned their use of explosives and a future planned event, to act on their emotions and motivations of the moment.  Domestic Terrorism in the United States will continue at a rapid pace without a more serious focus, on Homegrown Violent Extremism.

Whether it be online with the trust of your data systems or offline with the safety and security of your citizens, employees and facilities, beware of the changing opportunities for your adversaries, to launch their attack...
Utility, leveraged by your adversaries, is a consideration that must be continuously evaluated and analyzed in your particular threat environment.

The reengineering of the Internet is now underway for our next generation beyond the millennials.  The unification of corporate software development and information security teams are experiencing a deja vu and reminiscent of scenes from the 1993 movie "Groundhog Day."  Operational Risk Management (ORM) is hopeful that we are having a new resurgence of software vulnerability management thinking.  Why?

In 2007, a class action lawsuit was filed in the United States District Court of the Northern District of California against Facebook on behalf of 3.6 million users of Facebook concerning its “Beacon” program. KamberLaw represented the plaintiffs in this action and Cooley LLP represented Facebook. This suit was settled in 2009 and was granted final approval by the Hon. Richard Seeborg in March 2010. As part of the settlement, the parties created the Foundation (the Digital Trust Foundation) “the purpose of which shall be to fund projects and initiatives that promote the cause of online privacy, safety, and security.” The case settled for $9.5 million, with the Foundation receiving approximately $6.7 million after attorney’s fees, payments to plaintiffs, and administrative costs. There were four objectors to the settlement, two of whom appealed the approval to the Ninth Circuit Court of Appeals and subsequently the Supreme Court. But ultimately, in November 2013, the appeals were rejected and the Foundation was funded. The Foundation will distribute more than $6 million and will close its doors once all of the grants have been distributed and completed.

The corporate Board of Directors conversations about the topic of "Digital Trust" is now ongoing and the subject of new business units.  Security vs. Privacy has been a recent media frenzy between some of our technology companies and the U.S. government.  Your elected officials in the U.S. House of Representatives are also on the hot seat now, to produce new relevant legislation.  The courts are adding more privacy and data breach cases to the docket each week.  The "Digital Equilibrium Project" is being established and will hopefully include an international set of stakeholders.

Authoring the rules that everyone understands and everyone can agree on, sets the stage or playing field for the environment of competition to engage with some sense of civility.  Rules will be broken in plain sight and the referee (law enforcement, judges, courts, juries) will impose a penalty, while potentially millions of people watch live.  Is it a penalty kick or just a loss of down?

Think global.  Think at the speed of light.  Think about the trust of e-commerce transactions where millions of people rely on our computing machines every waking minute of the day.  Where Zettabytes of data are in use.  The rules on the "Digital Playing Field" are vital to our future social and economic well being.

"Rugged DevOps" is another and necessary component of a safe, private and secure Internet ecosystem.  Operational Risk Management (ORM) professionals are evermore concerned, with the root cause of our current Privacy vs. (soon to be "And") Security headlines.  Digital Trust is hard to achieve and yet easy to forfeit.  It is time for us to begin "Reengineering for our Next Generation".

Legal Risk: The Insider Threat from Outside Counsel...

What will the "New Normal" be for the United States in the era of increased scrutiny on privacy law, civil liberties and the continuous quest for the security of the Homeland?  Operational Risk Management (ORM) professionals are ever more focused on "Information Operations" and counterintelligence functions while simultaneously working side-by-side, with their own General Counsel.  The laws in each state are changing and being updated as the Federal legislation stalemate continues:
Connecticut Updates its Data Security Laws, Imposing Stringent New Requirements By Ellen Moskowitz on July 15th, 2015 Posted in Legislation

On June 30, 2015, the Governor of Connecticut signed into law S.B. 949, “An Act Improving Data Security and Agency Effectiveness.”[1] The new law updates Connecticut’s data security laws, including by adding a 90-day hard deadline for data breach reporting, requiring companies in some cases to offer data breach victims a year of free identify theft prevention services, imposing new and specific data security program requirements on health insurance companies and other entities subject to Insurance Department regulation, and requiring state agencies to impose certain detailed security requirements on state contractors that maintain personal information. With a near constant stream of data breaches affecting entities from health insurers to retail giants to the government, the law responds to growing fears of data security.

Under the new law, beginning October 1, 2015, a data breach will require any person or entity conducting business in Connecticut to give notice “without unreasonable delay,” but now no later than 90 days after discovery of the breach, to state residents whose personal information was breached or reasonably believed to have been breached. The Connecticut Attorney General stated in a press release that 90 days is an “outside limit” that does not diminish his discretion to take action against entities who “unduly delay” notification.[2] Importantly, the law also requires the provision of at least twelve months of free identity theft prevention and mitigation services, but only in cases where Social Security numbers are breached or reasonably believed to have been breached.
If you happen to be concerned about the "Insider Threat" within your enterprise, then you realize the importance of creating the foundations for a sound legal framework.  One that addresses the rules that must be followed and the protocols for building trust with key corporate partners.  This includes the outside counsel that your enterprise engages with on an annual basis.

So what legal duty of care do your retained outside counsel have to secure your information?  What do they have in the environments that they operate in that may cause additional legal risks for your enterprise?  Do they understand the difference between information security and confidentiality?

First tier supply chain partners such as outside counsel are no different than the cloud provider or the HVAC contractor that may have access to the corporate network.  So what is the root cause of substantial intellectual property theft and industrial espionage targeted on law firms?  Failing to understand the vast landscape of "Operational Risk."  This includes negligent conduct and intentional misconduct.  So what can you do now to improve the outcomes of managing the legal risks of "Outside Counsel"?

Start a Dialogue:  Request a commitment to review the privacy vs. security environment of the key retained firms who provide the outside legal work for the enterprise.  Provide a case example of your corporate information security structure and priorities.

Ask Questions:  The whole spectrum of information security deserves a deep dive in the dialogue on managing digital information, making effective "Trust Decisions" and addressing eDiscovery and Records Management questions.

Team Together:  What if you worked with your outside firm to create a solution that included a collaborative design, prioritized execution, insisted upon cooperative feedback and insured continuous improvement?  Get your legal teams to train together with your CISO and CIO security teams.

Revise the Engagement Letter:  The contracting language must include the nuances of information security, privacy controls and an informative strategic plan for the inevitable point in time when there is a data breach at your outside counsel.  More here:
As Willie Sutton supposedly said, he robbed banks “because that’s where the money is.”  That also explains why law firms and lawyers are increasingly the targets of cyber-intrusion, particularly phishing scams.  Apparently, phishing in legal waters can yield a full net of stolen information.

“Most likely” to take the bait
Verizon’s 2015 Data Breach Investigations Report has found that a company’s legal department is among the ones that are “far more likely to actually open [a phishing] e-mail than all other departments.”

In case you’ve been living under a rock, “phishing” is the attempt to obtain sensitive information fraudulently by means of a deceptive electronic communication that appears to come from a trustworthy source.  (Some link the term to the indie rock group Phish, but according to Computerworld magazine, the term was coined round 1996, with the obvious analogy to the sport of angling using a lure.  Under that view, the “ph” is a nod to an old form of telephone hacking known as “phone phreaking.”)

Shockingly, Verizon found that 23 percent of recipients open phishing messages, and 11 percent click on the fatal attachments.

Data Rupture: The Risk of Over-Classification...

As a result of the latest "data rupture" at the U.S. Office of Personnel Management (OPM), there are several Operational Risk factors.  The issues that most people are focused on, dwells on a lack of proper information security controls or antiquated technologies, that have not kept up with the speed of the modern day asymmetric threat.

However, this is not the primary problem that needs to be resolved.  The problem definition has been discussed in the wings of government for many years.  The root of the discussion is really a personnel hiring process combined with a human resource function.  The next level of the debate has to do with the classification of information.  The process by which certain types and kinds of information is classified at different levels of sensitivity.

In terms of the private sector vetting of an employee for employment vs. the government employee (contractor) it is very similar for non-executive personnel at the "Secret" level of classification.  You could leap to the analogy, that once you move to an executive level in the private sector, you may be vetted more thoroughly including more extensive looks into references, interviews with others and a deep dive into financial affairs.  This is more in line with the "Top Secret" level clearance in the government.

Last year's massive hack of the US Office of Personnel Management's security clearance system affected 21.5 million people, including 1.8 million people who didn't apply for a background investigation, officials said Thursday, making it official the breach was the worst in US government history.

The new figure includes most, if not all, of the 4.2 million people the agency previously said were exposed in a separate breach of personnel files. The much larger number resulted from the hack in June or July of last year on the system used to conduct background checks on contractors and other private sector employees, as well as federal workers. Some 1.1 million of the stolen records included applicants' fingerprints. Background checks for people applying with the Central Intelligence Agency weren't affected because that agency conducts its own security clearance investigations.
 The tagging of information at the point of creation, inside the walls of the private enterprise or government is the key problem set.  Then making the decision on who and why a person needs this information for them to do their job, is the secondary factor.  We all need information to do our assigned jobs and tasks.  When information is tagged as "For Official Use Only", "Confidential" "Secret" or "Top Secret" in the government, there is a reason.  The Classification system:
The United States government classification system is established under Executive Order 13526, the latest in a long series of executive orders on the topic.[1] Issued by President Barack Obama in 2009, Executive Order 13526 replaced earlier executive orders on the topic and modified the regulations codified to 32 C.F.R. 2001. It lays out the system of classification, declassification, and handling of national security information generated by the U.S. government and its employees and contractors, as well as information received from other governments.[2]
The desired degree of secrecy about such information is known as its sensitivity. Sensitivity is based upon a calculation of the damage to national security that the release of the information would cause. The United States has three levels of classification: Confidential, Secret, and Top Secret. Each level of classification indicates an increasing degree of sensitivity. Thus, if one holds a Top Secret security clearance, one is allowed to handle information up to the level of Top Secret, including Secret and Confidential information. If one holds a Secret clearance, one may not then handle Top Secret information, but may handle Secret and Confidential classified information.
When you work as an employee of a private company, there is a documented personnel hiring process.  The early part of the process in some cases is outsourced to recruiting agencies, just as the government uses contractors to process many of it's back ground investigations.  In both cases, the reason is evident.  Does this person being considered for employment, pose a risk to the enterprise?

 The purpose of the discussion now is to look at the information.  The tagging of information at its origin.  Whether in the private sector or government.  Who decides what sensitivity to put on the document, picture, video, spreadsheet, text, audio or other data element?  How do you keep only certain people from viewing and reading or listening to the information with the correct level of security clearance? (Access Controls)  Certainly the viewing of the salary levels of all employees inside the private sector company is sensitive and only certain people have the authority and need to see this information.  The assurance of information is critical:  Confidentiality, Integrity and Availability.  No different in the government.  So what is the common thread?
Information security, sometimes shortened to InfoSec, is the practice of defending information from unauthorized access, use, disclosure, disruption, modification, perusal, inspection, recording or destruction. It is a general term that can be used regardless of the form the data may take (e.g. electronic, physical).[1]
The failure at OPM is complex and no different than the complexity of the data breach failure at Target Corporation.  Both incidents were and are the basis for case studies in Information Security classes at the academic level.  Each has idiosyncrasies, in terms of the actual data breach methodologies and the tools used by adversaries.  So what?

One has to question the need for so many people to have "Top Secret" security clearances in the government.  When you look at the numbers it is staggering.  It almost seems that the process for hiring good people in the government made it a requirement, that someone have the ability to obtain a "Top Secret" clearance.  Even though the likelihood that this person would ever be exposed to or asked to review "Top Secret" information was low.  The failure is that so many people were required to obtain Top Secret clearances, when it was not really a factor for the job they were doing or would ever do.

Now that the "Chinese hackers" (the so called suspects) have our SSN, DOB, previous addresses, (same for family members), financial and other references in their database, time will only tell what individuals will be targeted and for what.  So for those "Chinese hackers," here is a news flash:

"NOT ALL THE PEOPLE WITH GOVERNMENT TOP SECRET CLEARANCES HAVE REVIEWED TOP SECRET INFORMATION"

This is why, much of the hiring and background process that is part of the human resources systems is out of synch, with the information classification process and what someone needs to do their particular tasks in the enterprise.  The level of security clearance has unfortunately become a badge of acceptance and of perceived importance.  Just look at the number of "Linkedin profiles" today, where someone openly declares their "particular level of security clearance" with the government.  Why do people do this?

Metadata: Evidence of Terrorism vs. Crime...

What are the enterprise risks when metadata is legally defined as property?  Operational Risk Management (ORM) professionals are on high alert these days.  The court systems within the EU and now the United States, are building new cases and establishing new arguments.

As a steward of data and providing oversight on the transparency of how information is tagged, sorted, stored and archived, the ORM professional is right in the middle of the debate.  Metadata relevance is known to those who have been practicing the science and art of digital forensics for years.

Does your organization issue corporate devices for use in the workplace or on the job?  What transparency was provided when the digital device was issued on the use and ownership of the data associated with the device?  How many pages is the "Acceptable Use Policy" at your organization?

These policies on Mobile Device Management (MDM) or Bring Your Own Device (BYOD) are not new, yet they are still evolving.  This is because the technology innovation is so far advanced than the current legal precedence or court rulings.  The law will always catch up to technology and now the law is getting to an important milestone.

This however does not change how our adversaries are operating.  The current environment over the relevance of data, or who owns the metadata on our mobile devices, will not change the appetite for those who seek the data or exploit systems to cause failure or destruction.  If all of the laws in our land would stop crime or malicious intent in its tracks, then we could eliminate the entire legal enforcement structure.

The General Counsel and the outside legal teams at your organization are already working to reduce the risk of adverse litigation by employees, partners and customers.  The Chief Privacy Officers (CPO) and Chief Information Security Officers (CISO) are working 24/7 in tandem to operate legally and to insure the confidentiality, integrity and assurance of metadata across the globe.  Unfortunately they operate in an environment that involves humans, using digital devices.

The legal frameworks are quickly responding to the rising digital crime rate across the globe.  They are weary of the "Asymmetric Warfare" being waged by nation states.  Plaintiff lawyers are now preparing their new privacy and data breach cases on a weekly basis.  Organizations are seeking avenues of "Safe Harbor" by using certain products inside their infrastructure.  Yet will this all stem the tide of what weapons the adversaries are deploying, to perpetuate their business or espionage models?

This brings us to a prediction.  We predict the rise of metadata evidence that proves that organizations are the victims of cyber-terrorism, not cyber-crime.  Terrorism not fraud.  And now the courts and the jury pools will now decide what metadata is evidence and what the definition is of "Terrorism" in the cyber realm.  Marketing is a powerful engine to influence buyers.  Buyer beware:
"Last week, the Department of Homeland Security (DHS) certified FireEye under the SAFETY Act, providing their customers protection from lawsuits or claims alleging that the products failed to prevent an act of cyber-terrorism.
The news of the certification was reported by FireEye in a press release, and stipulates that FireEye’s Multi-Vector Virtual Execution engine and Dynamic Threat Intelligence platform are the two products now on the SAFETY Act approved technologies list."
"The core of this is something we’ve been debating for a while: the definition of terrorism, and whether or not it can apply to cyber-stuffs. Board Directors Perspective: Data Risk Business Process Reengineering...

The ranks of established Fortune 500 companies have been studied in the latest NYSE Corporate Board Member's Annual Directors Survey.  Spencer Stuart asked several telling questions in the Operational Risk Management (ORM) domain and the results may be enlightening:

This year we received nearly 500 responses from directors who didn’t mind sharing their opinions and comments on these issues. More than 70% came from those who identified themselves as outside directors, and another 20% said they serve as board chair or lead director. Forty-four percent have served on a board for more than 10 years, and another 33% have served five to 10 years. Just over 30% are at companies whose annual revenues are in the $1.1 billion to $5 billion range.

In fact, 55% of the directors we surveyed don’t believe it’s reasonable to expect that a public company board can ever fully get its arms around all the different aspects of risk in the current corporate environment (Figure 1), particularly the newer forms of technology risk like cyber risk and social media risk.
If you think "Social Media Risk" is NOT on the mind of the Board of Directors these days, then you would be correct:

The Social Media Risk to the enterprise has yet to be clearly defined to the majority of the Directors these days or they need more education on what the risks really are to the company.

If you think in 2015 a majority of the Board of Directors are still unsure about "Cyber Risk" you would also be correct:

The oversight of "Cyber Risk" to the enterprise is still in question by 85% of the Directors.  Why?

To quote Spencer Stuart's Report:
Boards must be ready to oversee a myriad of risks, especially those related to cyber security—and the social media realm—which is unfamiliar territory for some current directors (Figure 6). As a result, forward-thinking boards looking to refresh their ranks will want to add members who have technological and social media experience to guide the board in an arena where it is all too easy to make innocent but often damaging corporate blunders. Boards also value directors who have industry, financial, and regulatory experience, our results show.
Unfamiliar territory for Board Members?  Some current directors who are focused on corporate strategy or mergers and acquisitions would certainly not always have the knowledge or understanding of what the real "Operational Risks" are in the cyber and social media categories.  This makes sense.

What about adding new Board Members who have cyber and social media experience?  The enterprise must certainly pivot and adapt to this changing landscape of risks.  Will adding new Board Members make a difference?  Not likely.

There are some who are now advocating a "Presumption of Data Breach" strategy.  Simply put, what are we doing now, that our enterprise has been breached?  Instead of, what will we do if we ever have a data breach?  This subtle shift in thinking around the Board Room might move the percentage higher from only 15% who are "very confident" in overseeing their enterprise Cyber Risk today.

What if the Board of Directors had a discussion with management each meeting about what they were doing to contain the breach?  You see, the shift in mindset begins a whole new set of dialogue that is proactive and working on an existing business problem that requires remediation but also new thinking.  Unlike the reactive strategy of waiting until the legal and regulatory rules mandate the admission that a breach has actually occurred.

Finally, what if the enterprise were to embark on a Data Risk Business Process Reengineering (BPR) initiative?  You remember the BPR era from the 90's right?  Having a "Presumption of Data Breach" strategy should require the complete reengineering of our Data Enterprise Architecture itself.

Is end-to-end encryption the answer?  No.  Is segmentation of network design the answer?  No.  Are Next-Generation-Firewall's the answer?  No.  Is corporate end user education on cyber risks the answer?  No.  Are new rules and legislation the answer?  No.  Is a combination of all of these the answer?  Probably yes.

Data Risk Business Process Reengineering is a topic worthy of discussion at the next Board of Directors Meeting.  Include all the stakeholders.  Allocate the funds and the resources.  Next year the goal will be for 25% of directors to be very confident in the oversight of cyber risk in the Corporate Board Member survey.

Information Leaks: Risk Of The Data Supply Chain...

There is a well known threat that has been talked about with the Board of Directors behind closed doors for years. This threat is not new to most Operational Risk Management (ORM) professionals and yet executive management is still in denial that it could happen to us. Have you or someone in your C-Suite ever awakened one morning and wondered how the companies new plans for a merger are now in the published press? What about that new research and development breakthrough that ends up with another company with a similar process being patented a week or a month ahead of you?

What is the threat? Call it competitive intelligence, economic espionage, press leaks, loose lips or advanced persistent threat (APT), it does not really matter. The threat remains from all those people, rivals, industry peers, countries, states, allies and enemies that are working 24 x 7 x 365 to copy your valuable information and use it for their own advantage. What advantage depends on who obtains the valuable information and how they will eventually use it or sell it.

What is even more fascinating to most subject matter experts, is the amount of information that is still created and allowed to be compromised in some way that is false, fake and designed to confuse the adversary. So what is it, that much of executive management still does not understand about all of this? 

The "source" of the vulnerability that is leaking or allowing the secret or confidential information to be compromised. They still to this day are naive to the potential source. This source is not even inside their own company or organization in many cases. It is within the organizations data supply chain somewhere, but where is it exactly?

The answer is only possible to narrow down, if you absolutely know where your data and secret or confidential information is collected, transported and stored, in the hands of trusted third parties, outside the four walls of your business. That is the remedial first step. Creating a definitive map of who has custody of your data through some kind of third party agreement. The agreement could be with any number of key business partners in your data supply chain:

  • Banker
  • Venture Capitalist
  • Accountant
  • Attorney
  • Insurer
  • Internet Service Provider
  • Utility
  • Data Telecom Provider
  • Wireless Telecom Provider
  • Payments Processor
  • Document Custodian or Shredder

This short list is a good place to begin your quest for better understanding where the source of your information leak may be. Now think about this list and ask yourself who might have the most robust set of staff, resources and technology savvy people to keep your data safe. Regardless of the service level agreements or engagement letters in place, who is the most vulnerable on this list?

Even more important may be the question of which one of your data supply chain business partners, has the least amount of resources, people and state-of-the-art detection systems for the APT, Zeus, and other mechanisms that are ex-filtrating your data to another country. When was the last time you asked any of your business partners to walk you into their IT department for a look around with your CIO or CTO?
Believe us when we say that if you get that "Deer in the Headlights" look on your business partners face, you are in trouble. You can bet that the attackers are not attacking you, as much as they are attacking your data supply chain. As an example, if you say in public or on your public filings that you have your primary outside counsel firm as "Red, White and Blue," you can be assured that your adversaries will take notice.
You see, just because your organization has spent millions or billions on new data centers with the most sophisticated technologies available to counter your cyber adversaries, how can you be sure that your business data supply chain has done the same? There is only one way to do that and it is in person and on site. You may consider this level of due diligence before handing over your business for the merger and acquisition project or the development of a vital new component for your new patented product. A model "Request for Information" (RFI) on the business partners controls and capabilities for securing your sensitive, confidential and secret information shall be a first step requirement.

The second step shall be to get an inventory of what systems your data supply chain partner has in place to mitigate the risk of a data breach. At the top of that list, should be the management system that governs all the other hardware and software systems. So even if your business partner says they are using RSA NetWitness or ScoutVision on their corporate networks and Good MDM for their mobile devices, that is not going to be enough.  More from Europol:

The overarching "Management System" is not about technology. It is not about your favorite eDiscovery or computer forensics guru. It is about the way your business partner trains and educates it's people. It is about how those people use relevant business controls to secure your secrets, confidential data and records. Look at their behavior around this topic of "Achieving A Defensible Standard of Care" and you will soon discover whether you have found the most ideal banker, accountant or attorney to entrust to your digital supply chain.
